The rules regarding partners are complex. Applicants must meet the definition of partner and be in a relationship with a qualifying person. A partner is defined as:

A spouse.

A civil partner.

An unmarried partner. As of 31 January 2024, the revised definition of an unmarried partner no longer emphasises prior cohabitation with their partner in a marriage-like relationship for two years. Instead, the definition now requires evidence of a relationship similar to marriage or civil partnership for at least two years. If not cohabiting, the couple must demonstrate an ongoing commitment to each other.

A fiancé, fiancée or proposed civil partner. Applications as a fiancé, fiancée or proposed civil partner cannot be submitted from within the UK.
Applicants can apply as unmarried partners even if they or their sponsor remain married to a previous partner, provided they can demonstrate that their current relationship is genuine and subsisting and that their previous relationship has permanently broken down. This is particularly beneficial for couples where one member cannot divorce due to laws in their country or because they have lost contact with a previous partner.
Some individuals may be eligible to apply for indefinite leave to remain before completing five years in the UK as a partner. This includes victims of domestic abuse and bereaved partners.
